Puppies T&C

Health Check and Owner's Right to Inspection

The Buyer has the right to have the puppy examined by a licensed veterinarian within 24 hours of purchase, at their own expense. This “health check” is defined as a thorough examination of the puppy’s overall health, including its condition, vital signs, and any immediate medical concerns. The Buyer must inform the Seller immediately of any health concerns or illnesses and provide a valid medical report signed by the on-site veterinarian.

Diagnosis and Return Policy

If the puppy is diagnosed with health conditions by the Seller’s partnered licensed veterinarian, the Buyer may return the puppy to the Seller, along with a written statement from the veterinarian detailing the diagnosis, for a full refund. Failure to have the puppy examined within the 24-hour period will nullify this warranty.

Keeping the Puppy

If the Buyer chooses to keep the puppy despite a diagnosis of a health condition, no replacement or refund will be provided, and all medical costs and treatments are the sole responsibility of the Buyer. The Seller will not be liable for any medical expenses incurred after the initial 24-hour period.

Medical Bill Compensation and Health Check Requirements

To qualify for medical bill compensation, the health check must be performed by a veterinarian affiliated with the Seller's designated partner vets. Compensation requests will be reviewed on a case-by-case basis. The Seller reserves the right to communicate with the on-site veterinarian to verify the illness or medical condition reported. All claims must be supported by appropriate documentation and submitted within 48 hours of the diagnosis.

Acknowledgment of Puppy Health

Both the Seller and the Buyer acknowledge that the puppy is in good health at the time of purchase. The Seller is not responsible for any acute illnesses that arise before the purchase if such symptoms were not evident during the puppy's time at the Seller's location. Any conditions not visibly present at the time of sale are excluded from medical compensation.

Indemnification and Liability Release

If any action or failure to act on the part of the Buyer results in any claim, suit, loss, damage, injury, death, or liability, the Buyer agrees to defend, indemnify, and hold the Seller harmless. This includes paying all of the Seller’s costs and expenses, including reasonable legal fees, any amounts paid in settlement, and any awards or judgments related to such claims. The Buyer also releases the Seller from any and all liability, costs, or damages caused by the puppy after placement with the Buyer, including but not limited to damage to or destruction of property and injury to any person.

Process for Reporting and Verification

The Buyer must report any health concerns to the Seller immediately upon discovery. The medical report from the Seller’s partner veterinarian should be submitted along with any claims for compensation. The Seller will review the report and may request additional information from the veterinarian to verify the illness or condition. The Buyer agrees to cooperate fully with this process.

Limitations of Liability

The Seller’s liability is limited to the terms specified in this agreement. The Seller is not responsible for any incidental, consequential, or indirect damages resulting from the puppy’s health issues.

Dispute Resolution

In the event of a dispute regarding this indemnity form or any claims, the parties agree to seek resolution through mediation before pursuing any legal action. Mediation will be conducted in accordance with the rules of any mutually agreed mediation organization.

Return Policy

If the Buyer wishes to return the puppy due to health concerns, it will be reviewed and subject to the Seller's decision. The puppy must be returned within 7 days of purchase. The Seller will provide instructions for the return process and any applicable conditions for returns.
